These Terms of Service (the “Terms”) govern your access to and use of the DevTune website, application, and related services (the “Service”). By registering for or using the Service, you agree to these Terms.

1. Accounts And Eligibility

  • You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.
  • We offer Personal Accounts and Team Accounts with roles and permissions. Team admins are responsible for invitations and member actions.
  • Keep your credentials confidential. You are responsible for activities under your account.

2. Use Of The Service

  • You may use the Service to track and improve your product's visibility across AI search platforms.
  • Do not upload or submit unlawful content or sensitive personal data. You must have the rights to the repositories and materials you test.
  • Do not misuse the Service, interfere with its operation, or attempt unauthorized access.

3. Subscriptions And Billing

  • Plans may include usage limits based on features and plan tier.
  • Paid plans renew automatically until canceled. Taxes may apply.
  • Payments are processed by our payment processor. We do not store full card details.
  • Cancellation: you can cancel at any time; your subscription will remain active until the end of the current billing period. Unless required by law, we do not provide prorated refunds for partial periods.

4. Trials And Beta Features

We may offer free trials or early access/beta features. These are provided “as is,” may change at any time, and may be subject to additional terms.

5. Customer Content

You retain ownership of content you submit to the Service. You grant us a worldwide, non‑exclusive license to host, process, and display that content solely to provide and support the Service.

6. Intellectual Property

We and our licensors own the Service and all associated intellectual‑property rights. These Terms do not transfer any IP rights to you.

7. Confidentiality

Non‑public information disclosed by either party that is marked or reasonably understood to be confidential must be protected and used only for the purpose of the relationship.

8. Privacy And Data Protection

Our processing of personal data is described in our Privacy Policy. You are responsible for obtaining any necessary consents and for not submitting sensitive personal data to the Service.

The Service may rely on third‑party providers (e.g., cloud, authentication, payment, analytics) and AI model providers to run analyses you request. Your use of third‑party services may be subject to their terms.

10. Availability And Support

We aim for high availability, but the Service may be unavailable for maintenance or due to factors outside our control. Support is provided on a commercially reasonable basis.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

12. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES; OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA. EXCEPT FOR YOUR PAYMENT OBLIGATIONS AND YOUR INDEMNITY, EACH PARTY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID OR PAYABLE BY YOU TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

13. Indemnification

You will defend and indemnify us against third‑party claims arising from your content, your use of the Service in violation of these Terms, or your violation of law.

14. Term And Termination

You may stop using the Service at any time. We may suspend or terminate access for breach or to protect the Service or other users. Upon termination, your license to use the Service ends.

15. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict‑of‑laws rules. Courts in England and Wales will have exclusive jurisdiction, except where prohibited by law.
